Marital relations before the husband pays the Mahr
Question
After a nikah was done and mahr was stipulated, can a husband have marital relations with the wife before he has actually paid her the Mahr?
Answer
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu 'alaykum wa-rahmatullāhi wa-barakātuh.
In principle, it is permissible for a husband to have marital relations with his wife even before paying her the Mahr. However, if it was agreed that the Mahr would be Mu'ajjal (immediate payment), the wife has the right to abstain from marital relations until the Mahr is paid.[1]

(وَلَهَا مَنْعُهُ مِنْ الْوَطْءِ) وَدَوَاعِيهِ شَرْحُ مَجْمَعٍ (وَالسَّفَرُ بِهَا وَلَوْ بَعْدَ وَطْءٍ وَخَلْوَةٍ رَضِيَتْهُمَا) لِأَنَّ كُلَّ وَطْأَةٍ مَعْقُودٍ عَلَيْهَا، فَتَسْلِيمُ الْبَعْضِ لَا يُوجِبُ تَسْلِيمَ الْبَاقِي (لِأَخْذِ مَا بَيْنَ تَعْجِيلِهِ) مِنْ الْمَهْرِ كُلِّهِ أَوْ بَعْضِهِ (أَوْ) أَخَذَ (قَدْرَ مَا يُعَجَّلُ لِمِثْلِهَا عُرْفًا) بِهِ يُفْتَى

قال - رحمه الله - (ولها منعه من الوطء والإخراج للمهر، وإن وطئها) أي لها أن تمنع نفسها إذا أراد الزوج أن يسافر بها أو يطأها حتى تأخذ مهرها منه ولو سلمت نفسها ووطئها برضاها لتعين حقها في البدل كما تعين حق الزوج في المبدل وصار كالبيع، وليس للزوج أن يمنعها من السفر والخروج من منزله حتى يوفيها مهرها

بغير مهر ادا کے بیوی سے ہمبستری کرنا جائز ہے- البتہ بیوی کو مہر کی بنا پر ہمبستری سے شوہر کو منع کرنے کا حق حاصل ہے۔ اگر مہر معجل باندھا گیا ہے
