Spouses right to Children

Question

Salaam

Me and my husband have 2 sons. I would like to have more children. When I asked my husband to try for a 3rd child he said no. The reason he says this is that I had hyperemesis with both pregnancies so it was difficult to manage. The 1st pregnancy I managed prettt much on my own despite living with in laws. 2nd time round I needed my family's help as my in laws were not helpful. We now live in our own home. He's saying no for anymore children  even though I can manage if I get bit of help ie get a carer. He said no as they are expensive but money isn't an issue for us alhamdulillah. I feel he's not trying to find a solution and is completely saying no without any options. 

I wanted to ask is he sinful for not giving me my right for more children?

Also is there anything in the Quran or hadith to back up me wanting kids and that the husband shouldn't Violate his wife's Rights.

Ive been very understanding And reasonable And have given him extra time to think it through but He isn't Budging.

I feel he's Neglecting me and not even bothered to fulfil my God-given rights/wishes.

In the Name of Allah, the Most Gracious, the Most Merciful. 

As-salāmu 'alaykum wa-rahmatullāhi wa-barakātuh.

Sister in Islam, 

A successful prosperous marriage is based on compromise between spouses.

The issue in reference is understood from the discussion of the Fuqaha with regards to Azl (contraception via pull-out method).[1]

The Fuqaha state that there is consensus that it is not permissible for a man to practice Azl without the permission of his wife if she is a free woman and not a slave-woman. This is because she has a right to have a child. The practice of Azl deprives her of this right. However, if she permits him to do so, it will be permissible for him to practice Azl. 

However, if the wife is a slave-woman (belonging to another master), the Fuqaha state that it is also not permissible for the man to practice Azl except with permission. However, in this situation, there are differences of opinion. 

According to Imam Abu Yusuf and Imam Muhammad (Rahimahumallah), the slave-woman's permission is required. This is because she has a right to fulfilment of her sexual desires and that is not achieved if Azl is practiced. 

According to Imam Abu Hanifa (Rahimahullah), Azl in the case of a freewoman was not permitted due to depriving her of a child as having a child was her right. Hence, her permission was required. Therefore, in the case of the slave-wife, the permission of the slave-wife's master is required as he has a right to the child of his slave-woman. Furthermore, although it is correct to say that the woman has a right to be sexually fulfilled, this is with regards to the principle act i.e., intercourse itself, not in the manner/method of its performance. That is why the wife of a man who is able to have intercourse but unable to ejaculate does not have any recourse to the Qadhi to annul the marriage on grounds of lack of sexual fulfilment.  

Therefore, a free woman has a right to children and should she desire so, the husband would be required to fulfil her right. If he fails to do so, he will be guilty of violating her right.

The following hadith of Rasulullah (Sallallahu Alaihi Wasallam) may be useful to present to your husband, 

تَزَوَّجُوا الْوَدُودَ الْوَلُودَ فَإِنِّي مُكَاثِرٌ بِكُمُ الْأُمَمَ 

Translation: "Marry women who are loving/compassionate and fertile for I shall boast with your numbers to the other nations." (Abu Dawud-2050)

وأيضا: فإن الولد يكون لها إذا كانت حرة، فليس له أن يمنعها حقها من الولد

ويكره للزوج أن يعزل عن امرأته الحرة بغير رضاها؛ لأن الوطء عن إنزال سبب لحصول الولد، ولها في الولد حق، وبالعزل يفوت الولد، فكأنه سببا لفوات حقها، وإن كان العزل برضاها لا يكره؛ لأنها رضيت بفوات حقها، ولما روي عن رسول الله - صلى الله عليه وسلم - أنه قال: «اعزلوهن أو لا تعزلوهن إن الله تعالى إذا أراد خلق نسمة، فهو خالقها» إلا أن العزل حال عدم الرضا صار مخصوصا،

ولا بأس للرجل أن يعزل عن أمته بغير إذنها (وأما) المنكوحة فإن كانت حرة يكره له العزل من غير إذنها بالإجماع لأن لها في الولد حقا وفي العزل فوت الولد ولا يجوز تفويت حق الإنسان من غير رضاه فإذا رضيت جاز وإن كانت أمة فلا بد من الإذن أيضا بلا خلاف لكن الكلام في أن الإذن بذلك إلى المولى أم إليها قال أبو حنيفة - رحمه الله - الإذن فيها إلى مولاها وقال أبو يوسف ومحمد رحمهما الله إليها (وجه) قولهما أن لها حقا في قضاء الشهوة والعزل يوجب نقصانا فيه ولا يجوز إبطال حق الإنسان من غير رضاه (وجه) قول أبي حنيفة - رضي الله عنه - أن الكراهة في الحرة لمكان خوف فوت الولد الذي لها فيه حق والحق ههنا في الولد للمولى لا للأمة وقولهما فيه نقصان قضاء الشهوة فنعم لكن حقها في أصل قضاء الشهوة لا في وصف الكمال ألا ترى أن من الرجال من لا ماء له وهو يجامع امرأته من غير إنزال ولا يكون لها حق الخصومة دل أن حقها في أصل قضاء الشهوة لا في وصف الكمال والله سبحانه وتعالى أعلم

قوله: (وعن زوجته) أي ويعزل عن زوجته (الحرة بإذنها) لأن لها حقاً في الوطء، حتى كان لها المطالبة بقضاء الشهوة، وتحصيلاً للولد، ولهذا تخير في الجب والعُنة

على ما في البحر: ذكر في الكتاب أنه لا يباح بغير إذنها وقالوا في زماننا يباح لسوء الزمان. اهـ

(قوله قال الكمال) عبارته: وفي الفتاوى إن خاف من الولد السوء في الحرة يسعه العزل بغير رضاها لفساد الزمان، فليعتبر مثله من الأعذار مسقطا لإذنها. اهـ. فقد علم مما في الخانية أن منقول المذهب عدم الإباحة وأن هذا تقييد من مشايخ المذهب لتغير بعض الأحكام بتغير الزمان، وأقره في الفتح وبه جزم القهستاني أيضا حيث قال: وهذا إذا لم يخف على الولد السوء لفساد الزمان وإلا فيجوز بلا إذنها. اهـ. لكن قول الفتح فليعتبر مثله إلخ يحتمل أن يريد بالمثل ذلك العذر، كقولهم: مثلك لا يبخل. ويحتمل أنه أراد إلحاق مثل هذا العذر به كأن يكون في سفر بعيد، أو في دار الحرب فخاف على الولد، أو كانت الزوجة سيئة الخلق ويريد فراقها فخاف أن تحبل، وكذا ما يأتي في إسقاط الحمل عن ابن وهبان فافهم
