Can a person sign up for an interest-based bank account, not for the benefit of the interest?

Question

As-salaamu ‘alaykum,

1) A bank account has 1-3% interest which is deposited into the account every month or so. The purpose of signing up with such an interest-based account is NOT to benefit from the interest, but simply because the interest-based account has no monthly or transaction fees and other such perks. So can a Muslim sign up for such an interest account, but remove the interest amount by giving it as sadaqa (charity) every month or so to purify the rest of the money in the account?

2) If the interest can be given in charity, besides the standard charitable venues such as masjid donations, the poor, etc, can we also give the interest in donation online to platforms such as Wikipedia or other such useful knowledge websites which sometimes ask for donations to keep their ad-free and non-profit platforms running?

3) Can the interest derived from the account be used to pay off other fees of the same bank, including mortgage from the same bank (since that would be like giving the interest back to the owner)?

4) Lastly, can that interest be used to pay off other payments such as normal mortgages and also Shariah-compliant mortgages/loans?

Kindly give a clear, detailed answer on all the scenarios above and any other information which might be relevant to the questions.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, any dealings associated with interest is haram[1] (strictly prohibited) and is a major sin. Allah Ta’ala has given a harsh warning for the one who deals with interest. The one who deals with interest will incur the wrath of Allah on oneself. Allah Ta’āla states:

يَا أَيُّهَا الَّذِينَ آمَنُوا اتَّقُوا اللَّهَ وَذَرُوا مَا بَقِيَ مِنَ الرِّبَا إِنْ كُنْتُمْ مُؤْمِنِينَ. فَإِنْ لَمْ تَفْعَلُوا فَأْذَنُوا بِحَرْبٍ مِنَ اللَّهِ وَرَسُولِهِ وَإِنْ تُبْتُمْ فَلَكُمْ رُءُوسُ أَمْوَالِكُمْ لَا تَظْلِمُونَ وَلَا تُظْلَمُونَ (سورة البقرة 278-279)

Translation:  O you who have believed, fear Allah and give up what remains (due to you) of interest if you are believers. And if you do not, then be informed of a war (against you) from Allah and His Messenger. But if you repent, you may have your principal, you do no wrong, nor are you wronged.

الَّذِينَ يَأْكُلُونَ الرِّبَا لَا يَقُومُونَ إِلَّا كَمَا يَقُومُ الَّذِي يَتَخَبَّطُهُ الشَّيْطَانُ مِنَ الْمَسِّ ذَلِكَ بِأَنَّهُمْ قَالُوا إِنَّمَا الْبَيْعُ مِثْلُ الرِّبَا وَأَحَلَّ اللَّهُ الْبَيْعَ وَحَرَّمَ الرِّبَا فَمَنْ جَاءَهُ مَوْعِظَةٌ مِنْ رَبِّهِ فَانْتَهَى فَلَهُ مَا سَلَفَ وَأَمْرُهُ إِلَى اللَّهِ وَمَنْ عَادَ فَأُولَئِكَ أَصْحَابُ النَّارِ هُمْ فِيهَا خَالِدُونَ (سورة البقرة 275)

Translation: Those who consume interest cannot stand (on the Day of Resurrection) except as one stand who is being beaten by Satan into insanity. That is because they say, "Trade is like interest." But Allah has permitted trade and has forbidden interest. So, whoever has received a warning from his Lord and stops, he may have what is past, and his affair rests with Allah. But whoever returns to (dealing in interest or usury) those are the companions of the Fire; they will abide eternally there.

Based on the above, signing up for an interest-bearing account or taking out mortgages is Haram (unlawful). However, if one has transacted in an interest bearing dealings, then one must make sincere Tawbah to Allah Ta’āla and come out of such transactions.

In principle, if one has already accumulated interest money, then it must be returned back to the owner. If this is not possible, then one must dispose of the accrued interest wealth by donating it to the poor and the needy. [2]

In the enquired situation, one cannot use interest money to offset, pay bank fees, or pay mortgages. However, if one has already taken out a mortgage, then one may use the interest money accumulated from the same bank to pay off the interest portion of the mortgage. [3]

As for using the interest money for online platforms, the view of the majority of the ulama is that the interest money must only be given to the poor and needy and not to public platforms and services.[4]

وله ولا بين المسلم والحربي في دار الحرب خلافا لأبي يوسف والشافعي ومالك وأحمد وعلى هذا الخلاف الربا بين المسلم الأصلي والمسلم الذي أسلم في دار الحرب ولم يهاجر إلينا فلو باع مسلم دخل إليهم مستأمنا درهما بدرهمين حل وكذا إذا باع منهم ميتة أو خنزيرا أو قامرهم وأخذ المال يحل كل ذلك عند أبي حنيفة ومحمد خلافا لأبي يوسف ومن ذكرنا لهم إطلاق النصوص فإنها لم تقيد المنع بمكان دون مكان والقياس على المستأمن منهم في دارنا فإن الربا يجري بين المسلم وبينه فكذا الداخل منا إليهم بأمان ولأبي حنيفة ومحمد ما روي أنه صلى الله عليه وسلم قال لا ربا بين المسلم والحربي في دار الحرب وهذا الحديث غريب ونقل ما روى مكحول عن النبي صلى الله عليه وسلم أنه قال ذلك قال الشافعي قال أبو يوسف إنما قال أبو حنيفة هذا لأن بعض المشيخة حدثنا عن مكحول عن رسول الله صلى الله عليه وسلم أنه قال لا ربا بين أهل الحرب أظنه قال وأهل الإسلام قال الشافعي وهذا الحديث ليس بثابت ولا حجة فيه أسنده عنه البيهقي قال في المبسوط هذا مرسل ومكحول ثقة والمرسل من مثله مقبول... وهذا لا يفيد معارضة إطلاق النصوص إلا بعد ثبوت حجية حديث مكحول وقد يقال لو سلم حجيته فالزيادة بخبر الواحد لا تجوز وإثبات قيد زائد على المطلق من نحو (لا تأكلوا الربا) ونحوه هو الزيادة فلا يجوز.

وفي المنتقى إبراهيم عن محمد رحمه الله تعالى في امرأة نائحة أو صاحب طبل أو مزمار اكتسب مالا قال إن كان على شرط رده على أصحابه إن عرفهم يريد بقوله على شرط إن شرطوا لها في أوله مالا بإزاء النياحة أو بإزاء الغناء وهذا لأنه إذا كان الأخذ على الشرط كان المال بمقابلة المعصية فكان الأخذ معصية والسبيل في المعاصي ردها وذلك هاهنا برد المأخوذ إن تمكن من رده بأن عرف صاحبه وبالتصدق به إن لم يعرفه ليصل إليه نفع ماله إن كان لا يصل إليه عين ماله

(قوله فيجب رد عين الربا لو قائما لا رد ضمانه إلخ) يعني وإنما يجب رد ضمانه لو استهلكه، وفي التفريع خفاء، لأن المذكور قبله أن البيع الفاسد من جملة الربا، وإنما يظهر لو ذكر قبله أن الربا من جملة البيع الفاسد، لأن حكم البيع الفاسد أنه يملك بالقبض ويجب رده لو قائما ورد مثله أو قيمته لو مستهلكا.

جتنی مقدار سود کی لی ہے اس کو واپس کر دے اور بقیہ سے کہانا اور کہلانا درست ہے ۔

اس مسئلہ میں علماء عظام اور مفتیان کرام کا اختلاف ہے اکثر مفتی حضرات یہ فرماتے ہیں کہ سود کی رقم کنواں کہودنے میں خرچ نہ کرے بلکہ بلا نیت ثواب فقراء پر صدقہ کردے۔
