Discounted Company shares as Employment Benefit

Question

Asalaamualakum respected Ulema,

The company I work for is a huge hardware/home improvement retailer and the vast majority of the profits they make are from selling halaal products.  The company does however pay and take interest from loans etc(it pays much more then it makes), and has other dealings with vendors that are not shariah complaint as it is a non muslim company.  The company also has more than 50% debt to assets, more than 40% interest loans to assets, and accounts payable 20% to assets. My Job in this company is as a merchandise planner and work with vendors to get goods to stores(halaal products), and try to avoid having any dealing with thier contracts with vendors although sometimes have to refer them to the buying agreeements for payments and vendor setups etc.   Based on this information can you please advise on the following:

1.company offers a benefit to employess where they can buy company shares at 15% off the market value.  This money is deducted monthly from salary and every 6 months shares are purchased on empolyee behalf with the discount.  I then go ahead and sell those shares immediatly at market value and take that 15% as profit.  I don't keep the shares any longer.  This is not an obligatory program but voluntary as an employee benefit.  Is this profit halaal if I sell immediatly at the end of each term?  If not do i give all the past profits to charity?

2. Company offer a bonus program of between 3-6% of wages every 6 months based on overall company performance.  Is this bonus halaal for me to accept?

3.  Overall is my employment and income in this type of company halaal?

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Respected Brother,

We commend you on your Deeni consciousness in earning halāl. May Allah Ta’āla grant you barakah in your wealth.

The answers to your queries are as follows:

1.      The Darul Iftaa has issued a detailed Fatwa which outlines the conditions required for permissibility to invest in company shares. These conditions apply whether one’s objective is to buy and hold or to sell in a short period of time. You may refer to the Fatwa here.[1]

In light of the information provided by you, it appears that the company does not comply with the interest-bearing debt to asset ratio. Accordingly, it is impermissible to invest or trade in shares of this company. It is advisable that you purify your income by donating past profits earned to charity.[2]

2.      Bonuses based on company performance are deemed to be gifts from the company to its employees. It will therefore be permissible to accept bonus payments from your employer.[3]

3.      Since your job as a merchandise planner entails the procurement of Halaal goods, your employment and income earned is Halaal.[4]

(قوله اكتسب حراما إلخ) توضيح المسألة ما في التتارخانية حيث قال: رجل اكتسب مالا من حرام ثم اشترى فهذا على خمسة أوجه: أما إن دفع تلك الدراهم إلى البائع أولا ثم اشترى منه بها أو اشترى قبل الدفع بها ودفعها  ...   وقال الكرخي: في الوجه الأول والثاني لا يطيب، وفي الثلاث الأخيرة يطيب، وقال أبو بكر: لا يطيب في الكل، لكن الفتوى الآن على قول الكرخي دفعا للحرج عن الناس اهـ. وفي الولوالجية: وقال بعضهم: لا يطيب في الوجوه كلها وهو المختار، ولكن الفتوى اليوم على قول الكرخي دفعا للحرج لكثرة الحرام اهـ

اگر کبہی  غلطی سے کوئی نا جائز طریقہ سے حاااصل کییی ہوئی رقم استعمال میں آجا‌ۓ تو توبہ اور استغفار کرنا چاہۓ اور تلافی کے لیے اتنی رقم صدقہ کرنا چاہۓ

وَفِي الْبَزَّازِيَّةِ غَالِبُ مَالِ الْمُهْدِي إنْ حَلَالًا لَا بَأْسَ بِقَبُولِ هَدِيَّتِهِ وَأَكْلِ مَالِهِ مَا لَمْ يَتَبَيَّنْ أَنَّهُ مِنْ حَرَامٍ؛ لِأَنَّ أَمْوَالَ النَّاسِ لَا يَخْلُو عَنْ حَرَامٍ فَيُعْتَبَرُ الْغَالِبُ وَإِنْ غَالَبَ مَالَهُ الْحَرَامُ لَا يَقْبَلُهَا وَلَا يَأْكُلُ إلَّا إذَا قَالَ إنَّهُ حَلَالٌ أُورِثْتُهُ وَاسْتَقْرَضْتُهُ وَلِهَذَا قَالَ أَصْحَابُنَا لَوْ أَخَذَ مُورِثُهُ رِشْوَةً أَوْ ظُلْمًا إنْ عَلِمَ وَارِثُهُ ذَلِكَ بِعَيْنِهِ لَا يَحِلُّ لَهُ أَخْذُهُ وَإِنْ لَمْ يَعْلَمْهُ بِعَيْنِهِ لَهُ أَخَذَهُ حُكْمًا لَا دِيَانَةً فَيَتَصَدَّقُ بِهِ بِنِيَّةِ الْخُصَمَاءِ
