Fatwa #38718 October 2001United States of America

ASA Mufti sb,Some close relative have borrowed money from me, on promise that they will return it.But they are not doing so.What is the islamic way of collecting money from borrowers.

Answer

There are two aspects to your query; a) Family ties, b) Having financial
dealings (loans, etc.) with them.

According to the Shari'ah, you have a right to claim the borrowed money from
your relatives. However, in doing so, you should be cautious as the
financial dealing should not harm the family relationship.

We advise you enquire from your relative the reasons for not paying the loan
and decide on any course considering the reasons for the delay.
