Did Talaq take place in the following situation?

Question

I have been maried for 2 months and there was constant brain wash of my wife happening from her father as our was love mariage.

- Her father and relatives brainwashed her to take khula, even my wife was not in wish to take khula.

- Even  was forced for khula by verbal and physical harrasment threat.

- We both under fear and pressure signed khulanamaa

-Also advocate asked me to pronounce 3 talak (i was of no intension of talaq and forced)

Now we both want 2 live together as my wife requested me to find a solution. She has not completed her iddat. We want to be maried again without halala. Please help us

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.   

Assalāmu ῾alaykum wa Rahmatullāhi Wabarakātu

We make dua Allah grant you courage to overcome your marital challenges. Be patient and turn to Allah as much as possible and make dua.

In principle, if you verbally issued three divorces to your wife, they will be valid even if you issued the divorces under duress. The three divorces will constitute a talaq-e-mugallaza (permanently irrevocable divorce). Both of you are haram upon each other. Halala is necessary for both of you to reconcile. [1]

ويقع الطلاق كل زوج بالغ عاقل ولو عبدا ولو عبدا او مكرها او هازلا او سفيها او سكران باشارتة او مخطئا [1] 

(رد المختار على الدر المختار ،كتاب الطلاق :3/241-235،سعيد)

و اما مطلاقات الثلث ،وهو زوال الملك وزوال المحلية أيضا ،حتى لا يجوز له نكاحها قبل التزوج بزوج آخر، لقوله عز وجل (فان طلاقها ،فلا تحل له من بعد حتى تنكح زوجا غيره)(بدائع الصنائع :4/403,دار الكتب العلمية،بيروت)

وان كان الطلاق ثلاثا فى الحرة ،وثنتين فى الامة لم تحل له حتى تنكح زوجا غيره نكاحا صحيحا و يدخل بها ، ثم يطلقها (الفتاوى العالمكيرية :1/473,رشيدية)
