If a husband tells his wife the following words “Get out of the house, I don’t need you anymore go where ever you want do whatever you want I am not bothered” will talaq take place?

Question

During an argument if a husband tells his wife to getout of the house i dont need you any more go where ever you want do what ever you want i am not bothered while saying this he had no intention or a thought of divorce in his mind or never ever he thought to divorce to his wife not even once in his life he loves his wife and have three beautiful childeren he never used a word talak  will the divorce still take place even without any intention  by saying all those words he only ment to leave him alone for a while

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

If the husband did not intend giving talaq to his wife with the statements in reference then such statements will not constitute talaq.[1]

الفتاوي الهندية  376/1ولَوْ قَالَ لَهَا اذْهَبِي أَيَّ طَرِيقٍ شِئْت لَا يَقَعُ بِدُونِ النِّيَّةِ وَإِنْ كَانَ فِي حَالِ مُذَاكَرَةِ الطَّلَاقِ وَفِي الْمُنْتَقَى لَوْ قَالَ لَهَا اذْهَبِي أَلْفَ مَرَّةٍ وَنَوَى الطَّلَاقَ يَقَعُ الثَّلَاثُ وَفِي مَجْمُوعِ النَّوَازِلِ لَوْ قَالَ لَهَا اذْهَبِي إلَى جَهَنَّمَ وَنَوَى الطَّلَاقَ يَقَعُ كَذَا فِي الْخُلَاصَةِ.
