Nafl Fast Before Qada’

Question

assalamu 'alaikum

A woman owes many days of obligatory fasting but she kept the fast of 'Arafah unknowingly the fatwa that keeping nafil fast is not recommended or valid before keeping the obligatory fasting.

Now, will her fasting on that Day of 'Arafah be counted as obligatory or nafil as she fasted with the intention of nafil and it is not right to combine fard & nafil fasting?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, qada’ fasts should be kept before keeping any nafl fasts. However, if one upon whom qada’ fasts are obligatory keeps a nafl fast on the day of ‘Arafa, the fast will be valid. The fast will be considered nafl.[1]

بدائع الصنائع في ترتيب الشرائع (٢/٨٥)

وإن كان الصوم دينا وهو صوم القضاء، والكفارات، والنذور المطلقة لا يجوز إلا بتعيين النية حتى لو صام بنية مطلق الصوم لا يقع عما عليه لأن زمان خارج رمضان متعين للنفل شرعا عند بعض مشايخنا، والمطلق ينصرف إلى ما تعين له الوقت، وعند بعضهم هو وقت للصيامات كلها على الإبهام فلا بد من تعيين الوقت للبعض بالنية لتتعين له، لكنه عند الإطلاق ينصرف إلى التطوع لأنه أدنى، والأدنى متيقن به فيقع الإمساك عنه
