Question
Is it halal to hunt birds or animals or game (for food purpose) while they are asleep at night?
Answer
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
Shari’ah does not prohibit hunting of animals or birds (whether they are asleep or not) provided that it is done for valid reasons, such as, acquiring meat, skin, bones, etc. However, it is disliked to engage oneself in hunting if it is done merely as a sport or without the intention of deriving any kind of benefit.[1]

[1] كِتَابُ الصَّيْدِ لَعَلَّ مُنَاسَبَتَهُ أَنَّ كُلًّا مِنْهُمَا مِمَّا يُورِثُ السُّرُورَ (هُوَ مُبَاحٌ) بَخَمْسَةَ عَشَرَ شَرْطًا مَبْسُوطَةٍ فِي الْعِنَايَةِ، وَسَنُقَرِّرُهُ فِي أَثْنَاءِ الْمَسَائِلِ (إلَّا) لِمُحْرِمٍ فِي غَيْرِ الْمُحْرِمِ أَوْ (لِلتَّلَهِّي) كَمَا هُوَ ظَاهِرٌ (أَوْ حِرْفَةٍ) عَلَى مَا فِي الْأَشْبَاهِ……
(قَوْلُهُ كَمَا هُوَ ظَاهِرٌ) لِأَنَّ مُطْلَقَ اللَّهْوِ مَنْهِيٌّ عَنْهُ إلَّا فِي ثَلَاثٍ كَمَا مَرَّ فِي الْحَظْرِ (قَوْلُهُ عَلَى مَا فِي الْأَشْبَاهِ) أَيْ أَخْذًا مِمَّا فِي الْبَزَّازِيَّةِ مِنْ أَنَّهُ مُبَاحٌ إلَّا لِلتَّلَهِّي أَوْ حِرْفَةً. وَفِي مَجْمَعِ الْفَتَاوَى: وَيُكْرَهُ لِلتَّلَهِّي

والاصطياد مباح فيما يحل أكله وما لا يحل فما حل أكله فصيده للأكل وما لا يحل أكله فصيده لغرض آخر إما الانتفاع بجلده أو شعره أو لدفع أذيته
