Fatwa #190319 January 2001United States of America

How can my fiance and I go about marrying over the phone, she lives in England and I am in Colorado.

Question

Her parents consent but cannot come to Colorado!

Answer

We are busy researching the ruling on marriage by telephone. However, the
Fuqahaa have explained the procedure of marriage for people intending to
marry from distant places, for example, England and Canada.

The procedure is: The girl, in the presence of two Shar'ee witnesses propose
to marry the boy. The proposal and the witness be reduced to writing with
the relevant details, date, signatures, etc. and be sent to the boy. The boy
accepts the written proposal in the presence of at least two Shar'ee
witnesses.

Upon fulfilling the above mentioned procedure, the Nikah between the two
parties living at distant lands will be complete.
