Can i take my wife back after Khula?

Question

I wanted to know if i granted my wife a khul can i re marry her?? on what terms???

Answer

In the name of Allah, Most Gracious, Most Merciful

Assalaamu `alaykum waRahmatullahi Wabarakatuh

Khul’a is when the wife offers to return primarily the Mahr in exchange of the husband divorcing her. If the husband agrees, then Khul’a will take place. Khul’a will constitute one Talaaq Baain (irrevocable talaaq). Hence, the nikaah will terminate and she will have to sit in Iddah.

فإذا فعلا ذلك وقع بالخلع تطليقة بائنة ولزمها المال  لقوله صلى الله عليه وسلم { الخلع تطليقة بائنة }

After the Khul’a, if you wish to reconcile then if your ex-wife accepts your proposal, it will be permissible for you to remarry her even though she is still in the Iddah and a new Mahr (dowry) will have to be given to her.

وينكح مبانته بما دون الثلاث في العدة وبعدها بالإجماع 

 (Ad-Durul Mukhtaar vol.3 pg409,HM Saeed)

وكذلك لو كان النكاح الأول صحيحاً وطلقها تطليقة بائنة بعد ما دخل بها، ثم تزوجها في العدة ثم طلقها في النكاح الثاني قبل الدخول بها فلها المهر الثاني كاملاً عند أبي حنيفة وأبي يوسف رحمهما الله.
