Fatwa #642616 August 2002Malaysia

My sister living with me who is single passed away. I have one sister and a brother. How will her property be divided and she have also nominated me as her beneficiary 100% in some of her property.

Answer

1. If you have parents, they will inherit from your sister's (daughters)
estate. The mother will inherit 1/6 and your father will inherit the
remainder of the estate. The brother and sisters will not inherit. You will
receive only as bequest to the maximum of 1/3 of her estate.
2. If you do not have parents, then your sister's estate will be divided
into 3 equal shares. Two for the brother and one for you.

The above is according to our understanding that the one sister referred to
have passed away.
