Spending 40 days for my deceased husband

Question

My husband died in Johannesburg but his Jannaza brought to Durban. Is it permissible for me to be there for his 40 days? My husband was in joburg and I was in Durban due to my work.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful. 

As-salāmu 'alaykum wa-rahmatullāhi wa-barakātuh.

If your husband passed away in Johannesburg, his Janazah should be in Johannesburg and not in Durban.

If you were in Durban at that time due to work, you should go to Johannesburg to attend the Janazah and spend your Iddah there if Johannesburg is the place of your marital home. Also, make Istighfar for violating the laws of Shariah.[1]

Nevertheless, the Iddah (waiting/mourning period) of a widow is four months and ten days (130 days) if she is not conceived. If she is conceived, her Iddah will be till birth. 

We do not believe in the forty days concept and practice.
