Hiring employees on a permanent contract - Is this permissible?

Question

Wanted to ask few questions.

1) Can we have permanent contracts? Meaning just a start date and any party is free to give 3 months’ notice to terminate

Someone mentioned that it will be difficult to give workers permanent contract as according to Shariah, an ijaarah (employment) contract should have a time limit.

Is there any way around this?

2) What's the ruling in Interest money accumulated in bank. Can I withdraw and give it to a poor non-Muslim who requires surgery but cannot afford?

It won't benefit me as this was an old maid I had 5+ years ago?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

1.     From an Islamic perspective, the word ‘permanent contract’ has the connotation of a contract with a fixed amount of time or service stipulated upon the employee, denoting an end period to the contract.

However, in secular terminology, unlike fixed-term or casual contracts, a permanent contract is one that will not expire but remain valid until either the employer or employee chooses to end the relationship. These are often called indefinite contracts as well.[1]

Essentially, a permanent contract is an automatically renewing monthly contract. In principle, from an Islamic perspective, if one stipulates a monthly salary for an employee without noting a specific date of termination, the contract will work on a month to month basis, automatically renewing each month. Therefore, employing someone on a permanent contract will be permissible.[2]

2.     At the outset, it is not permissible to enter into interest bearing agreements. Nevertheless, if one has accrued interest in his bank account, it must be disposed of by giving it away to the poor and needy (deserving recipients of Zakat).

It is permissible to give interest to poor non-Muslims, however, it is preferable to give it to poor Muslims instead.

Accordingly, you may give your maid the interest money for her surgery provided she is poor.[3]

(قوله وفسد في الباقي) مقيد بثلاثة أمور تعلم مما بعده بألا يسكن فيما بعد الشهر الأول، وأن لا يعجل أجرته، وأن لا يسمي جملة الشهور، فإن وجد واحد منها صح فيه

وفي البزازية: فلو أبرأه عن أجرة الأبد لا يصح إلا عن شهر واحد (قوله لجهالتها) أي الشهور. (قوله متى دخل كل) أي لفظ كل (قوله فيما لا يعرف منتهاه) كالأشهر والأيام، وهذا يفيد أن قوله " كل شهر " مثال، فمثله " كل سنة " أو يوم أو أسبوع كما أفاده الرملي. (قوله تعين أدناه) أي تعين للصحة، إذ ما بعد الأول داخل تحت العقد ولهذا اشترط حضورهما عند الفسخ فهو فاسد لكن ينقلب صحيحا بالسكنى هكذا يستفاد من كلامه

ثم رأيت الطوري قال: وظاهر قوله صح في شهر واحد الفساد في الباقي: قال في المحيط: وهذا قول بعضهم. والصحيح أن الإجارة كل شهر جائزة، وإطلاق محمد يدل عليه، فيجوز العقد في الشهر الأول والثاني والثالث، وإنما يثبت خيار الفسخ في أول الثاني؛ لأنها مضافة إلى المستقبل ولكل منهما فسخ المضافة اهـ، وهو مخالف لقول المصنف كالهداية والتبيين وفسد في الباقي، إلا أن يقال المراد بالفساد عدم اللزوم، وأطلق عليه ذلك؛ لأنه قابل للإفساد تأمل
