If I am in debt, can I give my land/property in waqf? Will the waqf be valid?

Question

I was informed by someone that it is not valid for an individual in debt to give away land/property as Waqf. Is this true? If I am in debt, can I give my land/property in waqf? Will the waqf be valid?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The information given to you is incorrect. If a person is in debt, he can make his land/property waqf. Ofcourse, he will still have to honour his debt and repay it.

The following text from Al-Muheet Al-Burhaani clarifies the position of our Fuqaha.[1]

رجل عليه ديون وله ضيعة تساوي عشرة آلاف درهم وشرط صرف غلاتها إلى نفسه قصداً منه إلى المماطلة وشهدت الشهود على إفلاسه جاز الوقف وجازت الشهادة، أما جواز الوقف فلمصادفته ملكه، وجواز الوقف مع هذا الشرط قول أبي يوسف على ما مر قبل هذا

أما جواز الشهادة فلأنها صدق؛ لأن الرقبة خرجت عن ملكه، فإن فضل من قوته شيء من هذه الغلات فللغرماء أن يأخذوا منه؛ لأن الغلات بقيت على ملكه

Translation: “A man has debts, and he has land worth 10,000 dirhams. He gives the land as waqf and he stipulates its proceeds for himself intending thereby to prolong his debt repayment. And witnesses attest to his bankruptcy, then the waqf is still valid and the testimony will also be valid. As for the validity of the waqf, it is due to the fact that it (his act) came from his ownership…”

The above text clarifies that a man is entitled to do as he pleases with regards to his own wealth/property. That includes giving his property in waqf despite him having debts on him.

Yes, if one has debts, it is better to first repay them. If one feels he will be able to repay his debts and also give his property as waqf without any injustice to his creditors, then that too is permissible.

وَفِي الملحقات رجل لَهُ ضَيْعَة تَسَاوِي عشْرين ألف دِرْهَم وَعَلِيهِ دُيُون ووقف الضَّيْعَة وَشرط صرف غلاتها إِلَى نَفسه قصدا مِنْهُ إِلَى المماطلة وَشهِدت الشُّهُود على إفلاسه جَازَ الْوَقْف وَالشَّهَادَة أما جَوَاز الْوَقْف فلمصادفته ملكه وَأما جَوَاز الشَّهَادَة فَلِأَنَّهَا صدق لِأَن بِالْوَقْفِ خرجت الضَّيْعَة عَن ملكه فَإِن فضل من قوته شَيْء من هَذِه الغلات فللغرماء أَن يَأْخُذُوا ذَلِك مِنْهُ لِأَن الغلات ملكه
