Is a woman to be blamed for being raped if she dressed provocatively?

Question

As salaam alaykum

In a recent discussion with a friend on the topic if rape he was if the opinion that if a lady is raped and she was dressed provocatively then she is also to blame for being raped and not only the rapist.

Jus wanted to know what the Islamic perspective is in these cases

1) dressed provocatively

2) not dressed provocatively

3) mixing and flirting with men

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Shariah has emphasized on shame and modesty.

عن يعلى أن رسول الله صلى الله عليه وسلم رأى رجلا يغتسل بالبراز بلا إزار فصعد المنبر فحمد الله وأثنى عليه ثم قال صلى الله عليه وسلم: إن الله عز وجل حيي ستير يحب الحياء والستر فإذا اغتسل أحدكم فليستتر (أبو داود 4012)

Translation: Ali (Radhiyallahu Anhu) narrates that Rasulullah (Sallallahu Alaihi Wasallam) saw a man bathing in a public place without a lower garment. So, Rasulullah (Sallallahu Alaihi Wasallam) ascended the pulpit and praised and glorified Allah. Then Rasulullah (Sallallahu Alaihi Wasallam) said Allah Taala is characterized by modesty and concealment. He loves modesty and concealment. So, when one of you shower, he should cover himself. (Abu Dawud 4012)

عن أبي أمامة عن النبي صلى الله عليه وسلم قال: الحياء والعي شعبتان من الإيمان، والبذاء والبيان شعبتان من النفاق (سنن الترمذي 2027)

Translation: Abu Umamah (Radhiyallahu Anhu) narrates that Rasulullah (Sallallahu Alaihi Wasallam) said modesty and minimal talking are two branches of Iman. Vulgar language and excessive talking are two branches of hypocrisy. (Tirmidhi 2027)

عن أنس قال: قال رسول الله صلى الله عليه وسلم: ما كان الفحش في شيء إلا شانه، وما كان الحياء في شيء إلا زانه (سنن الترمذي 1974)

Translation: Anas (Radhiyallahu Anhu) narrate that Rasulullah (Sallallahu Alaihi Wasallam) said: There isn’t indecency in anything except that it tarnishes it. There isn’t modesty in anything except that it beautifies it. (Tirmidhi 1974)

If a woman does not conceal her form and shape ,and dresses indecently, that is against shame and modesty. She will be sinful for dressing indecently.

If such a woman is raped, she will be responsible for her immoral conduct that led to rape. However, the rapist will not be absolved for his immoral conduct and sin. In an Islamic country, he will be punished according to the Shariah laws of Hudood (Defined punishments). [1] If he presents an excuse that the raped woman was dressed indecently and that incited him to rape her, that excuse will not be accepted. The rapist ought to have contained himself and avoided the evil act of rape. He will be responsible for his own action. Yes, a Government in an Islamic country can order women folk to dress decently and restrict them from indecent dressing in public to avoid shamelessness.

وإن كانت مكرهة من غير دعوى شبهة فعليه الحد دونها ولا مهر لها ثم ينظر في الإفضاء، فإن لم يستمسك بولها فعليه دية المرأة كاملة؛ لأنه فوت جنس المنفعة على الكمال.

وإن كان يستمسك بولها حد وضمن ثلث الدية لما أن جنايته جائفة، وإن كان مع دعوى شبهة فلا حد عليها، وإن كان البول يستمسك فعليه ثلث الدية ويجب المهر في ظاهر الرواية، وإن لم يستمسك فعليه الدية كاملة ولا يجب المهر عندهما خلافا لمحمد

وإن كانت مع دعوى شبهة فلا حد عليه ولا شيء عليه في الإفضاء ويجب العقر وإن كانت مكرهة من غير دعوى شبهة فعليه الحد دونها ولا مهر لها ثم ينظر في الإفضاء فإن لم تستمسك بولها فعليه دية المرأة كاملة وإن كانت تستمسك بولها حد وضمن ثلث الدية وإن كان مع دعوى شبهة فلا حد عليهما ثم إن كان البول يستمسك فعليه ثلث الدية ويجب المهر في ظاهر الرواية وإن لم يستمسك فعليه الدية كاملة ولا يجب المهر عند أبي حنيفة وأبي يوسف
