Selling cigarettes on the black market - Is this permissible?

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The harms of tobacco and cigarette smoking are abundantly clear. Therefore, the buying and selling of cigarettes is Makruh (highly disliked & detested).The income earned from selling cigarettes will also be Makruh. 

With regards to the sale of cigarettes illegally,  as citizens of South Africa we are bound to follow the laws of the country, as long as the laws of the country do not contravene the laws of Shariah and Islam. If one is convicted of violating the laws of the country he could be in an embarrassing situation.

Nabi (Sallallahu Alaihi Wasallam) said:

قال رسول الله صلى الله عليه وسلم: "لا ينبغي للمؤمن أن يذل نفسه" قالوا: وكيف يذل نفسه؟ قال: "يتعرض من البلاء لما لا يطيق." (ترمذي 2254)

Translation: "It is incorrect for the believer to humiliate himself.” The Sahaba said: How does he humiliate himself? Nabi (Sallallahu Alaihi Wasallam) replied: “By taking on a trial which he cannot bear.”(Sunan Al Tirmithi-2254)

We advise against selling cigarettes in general and on the black market.

However, if a person does illegally sell cigarettes his income will be Makruh due to the harms of tobacco and cigarette smoking. 

The violation of the laws of the country is a different issue.

قوله وصح بيع غير الخمر أي عنده خلافا لهما في البيع والضمان، لكن الفتوى على قوله في البيع، وعلى قولهما في الضمان إن قصد المتلف الحسبة وذلك يعرف بالقرائن، وإلا فعلى قوله كما في التتارخانية وغيرها.ثم إن البيع وإن صح لكنه يكره كما في الغاية

إن بيع العصير ممن يتخذه خمرا إن قصد به التجارة فلا يحرم وإن قصد به لأجل التخمير حرم..

(افترض عليه إجابته) لأن طاعة الإمام فيما ليس بمعصية فرض فكيف فيما هو طاعة بدائع(قوله: افترض عليه إجابته) والأصل فيه قوله تعالى "وأولي الأمر منكم" (النساء: 59) وقال - صلى الله عليه وسلم – "اسمعوا وأطيعوا ولو أمر عليكم عبد حبشي أجدع" وروي "مجدع" وعن ابن عمر أنه - عليه الصلاة والسلام – قال «عليكم بالسمع والطاعة لكل من يؤمر عليكم ما لم يأمركم بمنكر» ففي المنكر لا سمع ولا طاعة ثم إذا أمر العسكر بأمر فهو على أوجه: إن علموا أنه نفع بيقين أطاعوه وإن علموا خلافه كأن كان لهم قوة وللعدو مدد يلحقهم لا يطيعونه، وإن شكوا لزمهم إطاعته، وتمامه في الذخيرة
