Doubt of divorce
Question
Assalam o Alaikum. I submitted this question 3-4 weeks ago but didnt get any reply, hence submitting it again.
I have been happily married since the past 8 years. Recently during an argument with my wife she said out of frustration "Im so done with you". I became hurt and angry and replied " so go wherever you want to" without the intention of divorce. However later on i started getting wasawas regarding my intention. I'm quite sure that I didn't intend divorce but I'm getting a lot of wasawas recently regarding this making my life miserable and depressing.
in the light of the above situation, Please guide me whether my nikah is still valid. JazakAllah.
Answer
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
Brother in Islam,
May the Almighty bless your marriage. Aameen.
In principle, if the husband utters a word or a statement that has dual or multiple meanings and some of the meanings could mean divorce (talaaq), then divorce will take place only if the husband intended divorce with the word or statement.
In the enquired situation, you did not intend divorce by saying " so go wherever you want to".
Hence, this does not constitute a divorce and your Nikaah is intact. [1]
This incident should serve to remind you in future that intolerance leads one to tolerate a bigger problem.
We advise you not to ponder and build on these thoughts, as you will be aiding the shaytaan in fulfilling his mission. Do not allow the whispers of shaytaan to intimidate you.
- Constantly recite the undermentioned supplications/duas :
رَبِّ أَعُوذُ بِكَ مِنْ هَمَزَاتِ الشَّيَاطِينِ وَأَعُوذُ بِكَ رَبِّ أَنْ يَحْضُرُونِ
Translation: O Allah! I seek your protection from the evil whisperings of the Shaytaan, and, O my Rabb, I seek Your protection that they (the Shaytaan) approach me (because they always approach with evil).’”
(Surah Al-Mu’minoon, Verses 97-98)
لا حول ولا قوة الا بالله
Translation: There is no power to neither do any good nor prevent any evil except in Allah
- Recite the Ta’awwudh as much as possible.

وَلَا خِلَافَ أَنَّهُ لَا يَقَعُ الطَّلَاقُ بِشَيْءٍ مِنْ أَلْفَاظِ الْكِنَايَةِ إلَّا بِالنِّيَّةِ فَإِنْ كَانَ قَدْ نَوَى الطَّلَاقَ يَقَعُ فِيمَا بَيْنَهُ وَبَيْنَ اللَّهِ تَعَالَى، وَإِنْ كَانَ لَمْ يَنْوِ لَا يَقَعُ فِيمَا بَيْنَهُ وَبَيْنَ اللَّهِ تَعَالَى، وَإِنْ ذَكَرَ شَيْئًا مِنْ ذَلِكَ ثُمَّ قَالَ: مَا أَرَدْتُ بِهِ الطَّلَاقَ يُدَيَّنُ فِيمَا بَيْنَهُ وَبَيْنَ اللَّهِ تَعَالَى؛ لِأَنَّ اللَّهَ تَعَالَى يَعْلَمُ سِرَّهُ وَنَجَوَاهُ

وَحُكْمُهَا أَنَّهُ لَا يَجِبُ الْعَمَلُ بِهَا إلَّا بِالنِّيَّةِ أَوْ مَا يَقُومُ مَقَامَهَا مِنْ دَلَالَةِ الْحَالِ لِأَنَّهَا غَيْرُ مَوْضُوعَةٍ لِمَا اُسْتُعْمِلَتْ فِيهِ بَلْ تَحْتَمِلُهُ وَغَيْرَهُ فَلَا بُدَّ مِنْ التَّعْيِينِ أَوْ دَلَالَتِهِ
