Transmission of Najaasah - What should i do?
Question
Asalaam alaykum
Referring to the rule (posted as Fatwa 43631on the website askImam at http://www.askimam.org/public/question_detail/43631 ) regarding the transfer of Najis. I wanted to know if this rule (that Najis would transfer when two items come into contact, of which at least one item is Impure and one item is wet) is also appliable to "oil" (which is naturally produced on hair).
Answer
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
An object which has oil on it will be regarded as wet. Therefore, if oil was applied to the hair, it will be considered wet.
However, the natural condition of one’s hair will be considered dry. Hence, if a person's hair contains natural oil, it will be considered dry.
It is highly possible that the saliva of the dog had dried up, which would mean a dry object came into contact with the dry hair. Therefore, in this scenario, the Najaasah did not transfer.
However, if the hat was still wet with the dog's saliva, then the Najaasah transferred and the hair would have to be washed.
In addition, there is only doubt as to the impurity of the items mentioned. Therefore, the items in reference will remain pure until one has complete certainty that they are impure.
Whenever you are unaware or doubtful on the purity of any item, then as a precautionary measure you should wash that item. However, you should also avoid having unnecessary doubts. Rasullullah (Sallallahu Alayhi Wasallam) said:
عَنْ أُبَىِّ بْنِ كَعْبٍ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ "إِنَّ لِلْوُضُوءِ شَيْطَانًا يُقَالُ لَهُ الْوَلْهَانُ فَاتَّقُوا وَسْوَاسَ الْمَاءِ" (جامع الترمذي-۵۷)
Ubayy bin Ka'b narrated that: The Prophet (Sallallahu Alayhi Wasallam) said: "Indeed there is a Shaitan for Wudu' who is called "Al-Walahan." So beware of having misgivings about water." (Tirmidhi-57)
From the above Hadith, we ascertain that Shaytaan tries to cause unnecessary doubts in a person’s mind. One should not pay heed to these whisperings of Shaytaan.
