Account in children’s name - Kindly advise whether the above is Shariah Compliant
Question
Dear Mufti Saheb,
Hoping this email reaches Mufti Sb in good health.
Kindly advise on the following
My father in law had opened an account with Amaanat Investments in the name of my wife and her siblings.
He advised them of the following
1. He is the owner of the shares, it is merely for tax purposes and does not belong to them, even though it be in their names.
2. The scheme pays quarterly dividends; hence, the siblings will forward him for the 3 dividends, and they will keep the 1 as an Eid gift to them.
3. Should he pass on, then only will the ownership transfer to them, as it has been opened according to their Sharee rights to Islamic Laws of Succession.
I have been questioning myself regarding the Shariah compliance of the above arrangement as I am unhappy with it, especially if my wife should predecease her father.
Kindly advise whether the above is Shariah Compliant and how should we address it with her father.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
We hope and make Dua you are well. Maaf for the late reply.
Shari’ah has catered for the various challenges faced by people with regard to their wealth and possessions, especially due to the injustices experienced within society.
To facilitate protection from such injustice, the Fuqaha have acknowledged the concept of Bay’-ul-Talji’ah (Protected Transaction).[1] This is a mechanism wherein an individual portrays a transaction to be something contrary to its reality. It is used as a safety measure.
Example: Your father-in-law wishes to register an account in the name of his children for tax purposes. The reality is that the account still belongs to your father-in-law even though it seemingly belongs to the children on paper.
It is permissible to employ such methods. However, experience has shown that if such matters are not clarified to the heirs, disputes arise upon the demise of the original owner.
Therefore, we advise that your father-in-law clarifies to all his children and heirs that he is merely using their names for tax purposes and that the account still belongs to him. He should also record this in a separate document with signatures of all his children on it. Thereafter, upon his demise, the account will be distributed amongst his heirs as per the Islamic laws of inheritance.
Accordingly, if a child were to pass away before the father, that child will be excluded from the inheritance.[2]
It is permissible for the father to gift one of the quarterly dividends to his children as an Eid gift.[3]

وعلى هذا يخرج بيع التلجئة وهي ما لجأ الإنسان إليه بغير اختياره اختيار الإيثار وجملة الكلام فيه: أن التلجئة في الأصل لا تخلو إما أن تكون في نفس البيع، وإما أن تكون في الثمن فإن كانت في نفس البيع، فإما أن تكون في إنشاء البيع، وإما أن تكون في الإقرار به، فإن كانت في إنشاء البيع بأن تواضعوا في السر لأمر ألجأهم إليه على أن يظهر البيع، ولا بيع بينهما حقيقة وإنما هو رياء وسمعة نحو أن يخاف رجل السلطان فيقول الرجل: إني أظهر أني بعت منك داري وليس ببيع في الحقيقة وإنما هو تلجئة فتبايعا؛ فالبيع باطل في ظاهر الرواية عن أبي حنيفة، وهو قول أبي يوسف، ومحمد؛ لأنهما تكلما بصيغة البيع لا على قصد الحقيقة، وهو تفسير الهزل، والهزل يمنع جواز البيع؛ لأنه يعدم الرضا بمباشرة السبب فلم يكن هذا بيعا منعقدا في الحكم

وفي بيع التلجئة إذا قبض المشتري العبد المشترى وأعتقه لا يجوز إعتاقه، وليس هذا كبيع المكره؛ لأن بيع التلجئة هزل، وذكر في الأصل أن بيع الهازل باطل،

(وأقرب العصبات) جمع عصبة - وهو ذكر لم تدخل في نسبته إلى الميت أنثى - جزء الميت (جعل الشارع هذا خبر المبتدأ الذي هو قوله "أقرب العصبات") ، وهم (البنون، ثم بنوهم) وإن سفلوا بمحض الذكور (ثم) أصله، وهو (الأب، ثم الجد) وإن علا بمحض الذكور (ثم بنو الأب، وهم الإخوة) لأبويين، أو لأب عند عدم الإخوة لأبوين، ثم بنوهم كذلك وإن سفلوا بمحض الذكور (ثم بنو الجد، وهم الأعمام) لأبوين، أو لأب عند عدم الأعمام لأبوين، ثم بنوهم كذلك، وإن سفلوا بمحض الذكور (ثم بنو أب الجد) وهم أعمام أب الميت: لأبوين، أو لأب، ثم بنوهم كذلك وإن سفلوا، وهكذا؛ لأنهم في القرب والدرجة على هذا الترتيب؛ فيكونون في الميراث كذلك

"وتصح بالإيجاب والقبول والقبض" أما الإيجاب والقبول فلأنه عقد، والعقد ينعقد بالإيجاب، والقبول، والقبض لا بد منه لثبوت الملك

قال: "وتنعقد الهبة بقوله وهبت ونحلت وأعطيت"؛ لأن الأول صريح فيه والثاني مستعمل فيه. قال عليه الصلاة والسلام: "أكل أولادك نحلت مثل هذا؟ " وكذلك الثالث، يقال: أعطاك الله ووهبك الله بمعنى واحد "وكذا تنعقد بقوله أطعمتك هذا الطعام وجعلت هذا الثوب لك وأعمرتك هذا الشيء وحملتك على هذه الدابة إذا نوى بالحملان الهبة" أما الأول فلأن الإطعام إذا أضيف إلى ما يطعم عينه يراد به تمليك العين، بخلاف ما إذا قال: أطعمتك هذه الأرض حيث تكون عارية؛ لأن عينها لا تطعم فيكون المراد أكل غلتها؛ وأما الثاني فلأن حرف اللام للتمليك. وأما الثالث فلقوله عليه الصلاة والسلام "فمن أعمر عمرى فهي للمعمر له ولورثته من بعده" وكذا إذا قال جعلت هذه الدار لك عمرى لما قلنا. وأما الرابع فلأن الحمل هو الإركاب حقيقة فيكون عارية لكنه يحتمل الهبة، يقال حمل الأمير فلانا على فرس ويراد به التمليك فيحمل عليه عند نيته
