What is the punishment of doing Zina?

Question

What is the punishment of doing zina before marriage and how do you repent for it?

Answer

As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh

Zina is strictly prohibited and a major sin in Islam. See the following Ayat and Hadīth:

وَلَا تَقۡرَبُوا۟ ٱلزِّنَىٰۤۖ إِنَّهُۥ كَانَ فَـٰحِشَةࣰ وَسَاۤءَ سَبِیلࣰا (سورة الإسراء:32)

Translation: Do not even approach fornication for it is an outrageous act, and an evil way. (Surah Isrā: 32)

الزَّانِيَةُ وَالزَّانِى فَاجْلِدُواْ كُلَّ وَاحِدٍ مِّنْهُمَا مِاْئَةَ جَلْدَةٍ (سورة النور:2)

Translation: The adulteress and adulterer, whip each of them with a hundred stripes. (Surah al-Nūr: 2)

عَنْ عَبْدِ اللَّهِ، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " لَا يَحِلُّ دَمُ امْرِئٍ مُسْلِمٍ يَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللَّهُ، وَأَنِّي رَسُولُ اللَّهِ إِلَّا بِإِحْدَى ثَلَاثٍ: الثَّيِّبُ الزَّانِي، وَالنَّفْسُ بِالنَّفْسِ، وَالتَّارِكُ لِدِينِهِ الْمُفَارِقُ لِلْجَمَاعَةِ (مسند ابن أبي شيبة:244(

Translation: It was narrated that Abdullah bin mas’ūd (Radiyallāhu Anhu) mentioned that Prophet Muhammad (Sallallaahu ‘alayhi Wassallam) said:  "The blood of a Muslim may not be legally spilt other than in one of three instances: the married person who commits adultery, a life for a life, and one who forsakes his religion and abandons the community." (Musnad ibnu abi Shaibah: 244)

Moreover, in a muslim country, the punishment for a married person who committed zina is stoning to death. The punishment for an unmarried person is one hundred lashes.[i]

If one committed Zina, he should regret and make sincere Taubah and Istighfaar to AllahTa’ala.

The feeling of guilt over one’s sins is the first step towards repentance and reformation. Allah Ta’ala loves those who repent and pardons their sins. Regardless of the type of sin, if one sincerely repents to Allah, He will surely forgive him. No matter how grave the sin may be, a person should never despair of the mercy of Allah Ta’ala. Allah states in the Holy Quran:

إِنَّ اللَّهَ يَغْفِرُ الذُّنُوبَ جَمِيعًا إِنَّهُ هُوَ الْغَفُورُ الرَّحِيمُ (سورة الزمر: 53)

Translation: Verily Allah forgives all sins. Undoubtedly, He is the Most Forgiving, the Most Merciful. (Surah al-Zumar: 53)

One should make sincere tawbah (repentance) by performing two rak‘ahs of salah and then make sincere tawbah (repentance) with a firm resolve that he will not commit such an evil act again.

The conditions for an accepted tauba are,

1) Abandon the sin completely

2)Be remorseful over the sin

3)Make a firm resolution not to return to the sin

4)If the sin is related to the rights of people, that should be fulfilled.

If one fulfils the conditions of tauba, then be rest assured that he is forgiven. One of the signs of being forgiven is the person changes his life. He reforms himself and is more Allah conscious. In the context of Zina, abstain from those things that lead one to Zina, for example, lustful glances, intermingling with the opposite gender, pornography etc.

مسألة: اشتراط أربعة شهود لإثبات حد الزنا

قال أبو جعفر: (ولا يقبل في شهادة الزنى إلا أربعة، يشهدون على معاينه ذلك)

لقول الله تعالى: فاستشهدوا عليهن أربعة منكم وقال والذين يرمون المحصنات ثم لم يأتوا بأربعة شهداء فاجلدوهم

وقال النبي صلى الله عليه وسلم لهلال بن أمية حين قذف امرأته: "ايتني بأربعةٍ يشهدون، وإلا: فحد في ظهرك"، وهذا ما لا خلاف فيه

وفي حديث ابن جريج عن أبي الزبير عن عبد الرحمن بن الصامت عن أبي هريرة "أن ماعزًا شهد على نفسه أنه أصاب امرأة حرامًا أربع مرات، كل ذلك يعرض عنه

وفي حديث الزهري عن أبي سلمة عن جابر بن عبد الله: "أن الأسلمي شهد على نفسه أربع شهادات، فسأله النبي صلى الله عليه وسلم بعد ذلك، فقال: أبك جنون؟ " قال: لا، قال: أحصنت؟  قال: نعم، فأمر به فرجم
