Disrespecting the Ulama

Question

Assalamu alaikum warahmatullahi wabarakatuh

Respected Mufti Sahab,

If a Mufti issues a fatwa against the struggle of Muslims and which clearly implies that they are trying to appease the mushrikeen; and we call them ulama-e-soo and say that Allah's curse be on ulama-e-soo who have bartered away their deen for the dunya etc. Will it be considered as a disrepect for an elder or an aalim? If so, what should we now do to correct it when it is not possible for us to seek their forgiveness since it is not possible to contact them because of their high-profile status, and also the words which we used was behind their back?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Respected brother,

We are unaware of what you refer to when you speak regarding a fatwa against struggles of Muslims.

Nevertheless, we shall address your query with regards to disrespecting the Ulama.

The Ulama have always held great status within the Muslim Ummah. This is substantiated through the following verses of the Holy Quran and Ahadith of Rasulullah (Sallallahu Alayhi Wasallam),[1]

يَرْفَعِ اللَّهُ الَّذِينَ آَمَنُوا مِنْكُمْ وَالَّذِينَ أُوتُوا الْعِلْمَ دَرَجَاتٍ وَاللَّهُ بِمَا تَعْمَلُونَ خَبِيرٌ

Translation: “Allah elevates those who believe among you and those who have been granted knowledge in ranks and Allah is all-aware of what you do.” (58:11)

فإني سمعت رسول الله صلى الله عليه وسلم يقول: من سلك طريقا يبتغي فيه علما سلك الله به طريقا إلى الجنة، وإن الملائكة لتضع أجنحتها رضاء لطالب العلم، وإن العالم ليستغفر له من في السماوات ومن في الأرض حتى الحيتان في الماء، وفضل العالم على العابد، كفضل القمر على سائر الكواكب، إن العلماء ورثة الأنبياء، إن الأنبياء لم يورثوا دينارا ولا درهما إنما ورثوا العلم، فمن أخذ به أخذ بحظ وافر

Translation: “Rasulullah (Sallallahu Alayhi Wasallam) said: He who follows a path in quest of knowledge, Allah will make the path of Jannah easy to him. The angels lower their wings over the seeker of knowledge, being pleased with what he does. The inhabitants of the heavens and the earth and even the fish in the depth of the oceans seek forgiveness for him. The superiority of the learned man (Aalim) over the devout worshipper is like that of the full moon to the rest of the stars (i.e., in brightness). The learned (Ulama) are the heirs of the Prophets who bequeath neither dinar nor dirham but only that of knowledge; and he who acquires it, has in fact acquired an abundant portion.”

قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْعُلَمَاءُ خُلَفَاءُ الأَنْبِيَاءِ إِنَّ الأَنْبِيَاءَ لَمْ يُوَرِّثُوا دِينَارًا وَلا دِرْهَمًا إِنَّمَا وَرَّثُوا الْعِلْمَ

Translation: “The scholars are the successors of the prophets. Verily, the prophets do not pass on gold and silver coins, but rather they only impart knowledge.”

عن ابن عباس أن النبي صلى الله عليه وسلم قال: من يُرِد الله به خيراً يفَقِّهْهُ في الدَّين

Translation: “If Allah wishes well for a servant, he grants him understanding of Deen.”

من سلك طريقا يلتمس فيه علما، سهل الله له به طريقا إلى الجنة

Translation: “Rasulullah (Sallallahu Alayhi Wasallam) said, Allah makes the way to Jannah easy for him who treads the path in search of knowledge.”

قَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: لَيْسَ مِنَّا مَنْ لَمْ يَرْحَمْ صَغِيرَنَا وَيُجِلَّ كَبِيرَنَا وَيَفِ لِعَالِمِنَا

Translation: “He who does not show compassion to our young, does not respect our seniors and does not revere our Ulama is not from us.”

أَنَّ أَبَا الدَّرْدَاءِ قَالَ: كُنْ عَالِمًا أَوْ مُتَعَلِّمًا أَوْ مُحِبًّا أَوْ مُتَّبَعًا، وَلَا تَكُنِ الْخَامِسَ فَتَهْلِكَ. قَالَ: قُلْتُ لِلْحَسَنِ: مَنِ الْخَامِسُ؟ قَالَ: الْمُبْتَدِعُ

Translation: “Abu Darda (Radhiyallahu Anhu), said, “Be a scholar, a student, a devotee, or a follower; do not be the fifth type lest you be ruined.” It was said to Hasan, “Who is the fifth type?” Hasan said, “A heretic.”

أَنَّهُ كَانَ يُقَالُ: إِنِ اسْتَطَعْتَ فَكُنْ عَالِمًا فَإِنْ لَمْ تَسْتَطِعْ فَكُنْ مُتَعَلِّمًا، وَإِنْ لَمْ تَسْتَطِعْ فَأَحِبَّهُمْ، وَإِنْ لَمْ تَسْتَطِعْ فَلَا تَبْغَضْهُمْ

Translation: “‘Umar ibn ‘Abdul Aziz (Rahimahullah) said: “(People use to say) Become a scholar if you are able to. If you are not able, then be a student. If you cannot, then love them. If you are unable to do that also then (at least) do not hate them.”

The above is sufficient to display the lofty status knowledge and the people of knowledge (Ulama) enjoy.

Labelling an Aalim as Ulama-e-Soo is indeed a grave accusation. To call the curse of Almighty Allah upon him is even weightier. As Muslims, it does not behove us to curse a fellow Muslim who may have differences with us. Our responsibility is simply to tread the path of righteousness. We are not required to go out of our way and label others as deviant etc. Almighty Allah is the judge of mankind. How then can we decide to pass judgements over people, especially if we are not even fully aware of their circumstances.

Academic differences are not a form of disunity. If a Mufti applies his mind and comes to a conclusion, all the while being Allah conscious, then even if he errs, he will be rewarded.

You state that you accused the Aalim as being Ulama-e-Soo and cursed him. This was a wrong and brash decision on your part. Alhamdulillah, through the grace of Almighty Allah, you have seen the error of your ways.

First and foremost, you must exhaust all possible avenues in trying to reach the Aalim in reference and ask him for forgiveness. It is not necessary to spell out exactly what you said about him. Merely asking him to forgive you for any wrongs you may have committed against him will suffice. If this is not possible at all, then seek the forgiveness of Almighty Allah and ensure to make Dua for the Aalim. Making Dua for him will remove the ill feelings you may possess in your heart. Also endeavour to give sadaqah on his behalf and have hope in the mercy and forgiveness of Almighty Allah.

2682 - حدثنا محمود بن خداش البغدادي قال: حدثنا محمد بن يزيد الواسطي قال: حدثنا عاصم بن رجاء بن حيوة، عن قيس بن كثير، قال: قدم رجل من المدينة على أبي الدرداء، وهو بدمشق فقال: ما أقدمك يا أخي؟ فقال: حديث بلغني أنك تحدثه عن رسول الله صلى الله عليه وسلم، قال: أما جئت لحاجة؟ قال: لا، قال: أما قدمت لتجارة؟ قال: لا، قال: ما جئت إلا في طلب هذا الحديث؟ قال: فإني سمعت رسول الله صلى الله عليه وسلم يقول: «من سلك طريقا يبتغي فيه علما [ص:49] سلك الله به طريقا إلى الجنة، وإن الملائكة لتضع أجنحتها رضاء لطالب العلم، وإن العالم ليستغفر له من في السموات ومن في الأرض حتى الحيتان في الماء، وفضل العالم على العابد، كفضل القمر على سائر الكواكب، إن العلماء ورثة الأنبياء، إن الأنبياء لم يورثوا دينارا ولا درهما إنما ورثوا العلم، فمن أخذ به أخذ بحظ وافر»: ولا نعرف هذا الحديث إلا من حديث عاصم بن رجاء بن حيوة، وليس هو عندي بمتصل هكذا حدثنا محمود بن خداش بهذا الإسناد وإنما يروى هذا الحديث عن عاصم بن رجاء بن حيوة، عن الوليد بن جميل، عن كثير بن قيس، عن أبي الدرداء، عن النبي صلى الله عليه وسلم «وهذا أصح من حديث محمود بن خداش، ورأي محمد بن إسماعيل هذا أصح»
