Walima after rukhsati

Question

AsSalaamu Alaykum wa Rahmatullahi wa Barakatahu,

May Allah (swt) accept your efforts and reward you all and your families greatly. (Ameen)

Alhamdulilah I got my nikkah done last year. I am studying in college in my country while my husband is working in his country. We had our nikkah performed with both our family members and friends at a masjid and then they left after a couple days back to their home. In other words, I did not have my rukhsati because I am finishing my studies.

He came to visit me with the permission of my parents for a few days during the spring and summer breaks and the marriage was consummated. Both family members do not know this because I think culturally they assume that consummation will happen after the rukhsati ceremony; however, it happened during those short visits. We decided to give some money in sadaqah to a charity organization within that week but that was not considered the waleema (wedding feast) since we did not feed our family members yet. The actual rukhsati will be taking place in the beginning of next year when I finish my studies. The waleema is scheduled to take place 1.5 months after the rukhsati due to the spring break dates and travelling will be easier for guests after the tough winter whether conditions. 

Did we engage in anything impermissible? Is it okay if the waleema feast is given several months after the marriage is consummated? We are too embarrassed to disclose any of our personal matters with our family members so we would rather have the waleema feast around the time our parents think is suitable, is this okay in Islam? We request your advise and guidance in this matter. JazakumAllahu kharain katheerah!

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Sister in Islam,

We ask Allah Ta’ala to grant you blessings in your marriage and grant you pious offspring In Sha Allah.

It is permissible for the spouses to consummate the marriage any time after the Nikah. Accordingly, you and your husband did not do anything wrong.

It is advisable to have the Walima after the consummation. However, consummation is not necessary for a valid Walima.

The scheduled Walima will be a general family and friends gathering to express happiness upon the spouses living together. [i]

بذل المجهود (8\29)

واختلف السلف في وقتها ، هل هو عند العقد ، أو عقبه ، أو عند الدخول ، أو عقبه ، أو يوسع من ابتداء العقد إلى انتهاء الدخول ؟ على أقوال . قال السبكي : والمنقول من فعل النبي ة أنها بعد الدخول ، وفي حديث أنس عند البخاري وغيره التصريح بأنها بعد الدخول ، لقوله : أصبح عروساً بزينب فدعا القوم .

وَقَوْلُهُ: فِي الْبَدَائِعِ يَنْبَغِي أَنْ تَجُوزَ إذَا كَانَ أَحَدُهُمْ يَرَى الْوَلِيمَةَ يُؤَيِّدُهُ مَا فِي الْمُبْتَغِي مِنْ التَّنْصِيصِ عَلَى أَنَّهَا سُنَّةٌ حَيْثُ قَالَ الْوَلِيمَةُ طَعَامُ الْعُرْسِ وَالْخُرْسُ طَعَامُ الْوِلَادَةِ وَالْمَأْدُبَةُ طَعَامُ الْخِتَانِ وَالْوَكِيرَةُ طَعَامُ الْبِنَاءِ وَالْعَقِيقَةُ طَعَامُ الْحَلْقِ وَالنَّقِيعَةُ طَعَامُ الْقَادِمِ وَالْوَضِيمَةُ طَعَامُ التَّعْزِيَةِ وَكُلُّهَا لَيْسَتْ بِسُنَّةٍ إلَّا طَعَامَ الْعُرْسِ فَإِنَّهُ سُنَّةٌ لِقَوْلِهِ - عَلَيْهِ الصَّلَاةُ وَالسَّلَامُ - «أَوْلِمْ وَلَوْ بِشَاةٍ» وَيَنْبَغِي أَنْ يَدْعُوَ الْجِيرَانَ وَالْأَقْرِبَاءَ وَالْأَصْدِقَاءَ وَيَصْنَعَ لَهُمْ طَعَامًا وَيَذْبَحَ لَهُمْ وَيَنْبَغِي لِلرَّجُلِ أَنْ يُجِيبَ وَإِنْ لَمْ يَفْعَلْ فَهُوَ آثِمٌ وَإِنْ كَانَ صَائِمًا أَجَابَ وَدَعَا وَإِنْ لَمْ يَكُنْ صَائِمًا أَكَلَ اهـ.
