Al-Rayyan home purchase plan - Clarification
Question
Assalaamu Alaikum. In fatwa 34682# you stated that the Al rayyan home purchase plan is not right due to combining contracts and making the client pay maintenance. Al rayyan have responded:

Answer
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
One of the conditions for a valid partnership is the partners must share in the losses according to their ratio of partnership. [1] This principle is well known. The reference to this is in the footnotes. The Al-Rayan partnership model falls short on this principle. Take note of the following two clauses which violate the above-referred principle of Musharakah.
1) Al-Rayan has stated on their website: “However, sometimes a negative equity situation may arise when the sale price is lower than the initial purchase price. In this instance, since the sale is resulting in a loss, the Bank, as a partner in the property, has the right, under Sharia, to refuse the sale. Nevertheless, if the customer has special circumstances and really needs to sell, they can purchase the Bank’s share for the same initial purchase price. They may then sell the property to a third party at any price they are willing to take. This, however, may result in a loss for the customer.”
In the above scheme, the client (joint partner) is compelled to purchase the bank’s share for the initial price in “special circumstances”.
2) Al-Rayan has stated on their website: “In order for an Islamic bank to be able to offer the HPP at a competitive rental rate, it does not take on the responsibility of maintenance and insurance as part of the Ijara agreement.” In principle, one partner cannot bear all the costs of ownership on the grounds that the partner will eventually own the product. (قوله: ورجع على شريكه بحصته منه)؛ لأنه وكيل في حصة شريكه وقد قضى الثمن من ماله فيرجع عليه بحسابه. وفي المحيط: لأحدهما مائة دينار قيمتها ألف وخمسمائة وللآخر ألف درهم وشرطا الربح والوضيعة على قدر المال فاشترى الثاني جارية ثم هلكت الدنانير فالجارية بينهما وربحها أخماسا ثلاثة أخماسه للأول وخمساه للثاني؛ لأن الربح يقسم على قدر ماليهما يوم الشراء ويرجع الثاني على الأول بثلاثة أخماس الألف؛ لأنه وكيل عنه بالشراء في ثلاثة أخماس الجارية وقد نقد الثمن من ماله، ولو كان على عكسه رجع صاحب الدنانير على الآخر بخمسي الثمن أربعون دينارا؛ ولو اشترى كل واحد منهما بماله غلاما وقبضا وهلكا يهلكان من مالهما؛ لأن كل واحد حين اشترى كانت الشركة بينهما قائمة. اهـ. بحر ملخصا

وإن شرط الوضيعة والربح نصفان، فشرط الوضيعة نصفان فاسد؛ لأن الوضيعة هلاك جزء من المال، فكأن صاحب الألفين شرط ضمان شيء مما هلك من ماله على صاحبه، وشرط الضمان على الأخر فاسد، ولكن بهذا لا تبطل الشركة حتى لو عملا وربحا، فالربح بينهما على ما شرطا، فالشركة مما لا تبطل بالشروط الفاسدة، وإن وصفا بالوضيعة على قدر رأس مالهما، وأي المالين هلك قبل الشراء به هلك على صاحبه، هلك في يده أو في يد صاحبه، وانتقضت الشركة، وقد ذكرنا هذا في شركة المفاوضة.
بدائع الصنائع (ج7 ص513 العلمية)
إذا عرف هذا فنقول: إذا شرطا الربح على قدر المالين متساويا أو متفاضلا، فلا شك أنه يجوز ويكون الربح بينهما على الشرط سواء شرطا العمل عليهما أو على أحدهما والوضيعة على قدر المالين متساويا ومتفاضلا؛ لأن الوضيعة اسم لجزء هالك من المال فيتقدر بقدر المال

لالا يجوز اشتراط تحمل أحد الشريكين وحده مصروفات التأمين أو الصيانة ولو بحجة أن محل الشركة سيئول إليه.
