I have written a divorce letter to my wife & signed it

Question

Assalamu Alaikum I have written a divorce letter to my wife and signed on it in presence of a qazi and two persons as evidence. The qazi was about to send the letter within next 3 days.

I did it because she was caught red handed talking closely to a stranger over the phone. She was pregnant at that moment.

After 2 days, I thought I will give her one more chance to correct herself and stopped the letter and the letter was destroyed also informed two persons who was evidence of the divorce and started to live with her.

She has given birth of a baby girl one month ago. I thought it was necessary to deliver the letter to her for becoming the divorce effective and started living with her. Still she dont know about the incidence.

Recently I have asked an imam about it and he is saying the divorce has occured even my wife was not present and evidence was destroyed.

My question is, is my marriage still valid? if not, what can I do now?

Answer

In the name of Allah, Most Gracious, Most Merciful 
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh

The written divorce to the wife will be valid even if she did not know about the divorce and even if she did not receive the letter of divorce.[1]

You did not state what type of divorce you issued your wife and how many divorces you issued her. After divorce, she was in iddat until birth.[2] Upon birth the Nikāh has terminated.

If you issued her only one divorce and you did not give her two divorces before, then you may remarry her by performing a new Nikāh.[3]

 فقالوا: فإن كانت حاملا فنزل قوله {وأولات الأحمال أجلهن أن يضعن حملهن} [الطلاق: 4] ففي هذا بيان أن الحامل لا تحيض وإنها ليست من ذوات الأقراء وتبين بهذا أن قوله «إذا أقبل قرؤك» يتناول الحائل دون الحامل

تين طلاق کے بعد بغير حلالہ کے دو بارہ تجديد نکاح کر کےرکھنا حرام ہے
