Suspended Divorce with ambiguous words

Question

If husband said her wife that If he would do drinking again then their relation will over......and he did (drinking) after few months. (He didn't use the word of talaq or divorce, even he didn't intend to leave her wife). Actually, he said that, just to take her wife in confidence that he would not going to drink again in future; because his wife usually upset from him due to his drinking. Kindly tel the status of their relation ....

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh. 

In principle, if the husband utters a statement which has dual or multiple meanings and some of the meanings could imply divorce, then divorce would take place only if the husband intended divorce. In the enquired situation, the husband stated, “their relationship will be over”. The husband did not intend divorce from this statement; hence, this will not constitute a divorce.[1]

اللباب في شرح الكتاب (3/ 41)

(والضرب الثاني الكنايات) وهي: مالم يوضع له واحتمله وغيره (ولا يقع بها الطلاق إلا بنية أو دلالة حال) من مذاكرة الطلاق، أو وجود الغضب لأنها غير موضوعة للطلاق، بل تحتمله وغيره، فلابد من التعيين أو دلالته، لأن الطلاق لا يقع بالاحتمال

(وإذا أضافه) أي الطلاق (إلى) وجود (شرط وقع عقيب) وجود (الشرط) وذلك (مثل أن يقول لامرأته: إن دخلت الدار فأنت طالق) ، وهذا بالاتفاق، لأن الملك قائم في الحال، والظاهر بقاؤه إلى وقت الشرط، ويصير عند وجود الشرط كالمتكلم بالطلاق في ذلك الوقت
