Will paying a creditor rent for the house purchased using his money, be considered as interest?

Question

Asalam Alaikum Wrbu,

Dear Mufti Sb please let me know if the following is not interest and permissible to contract:

I, Person A, borrowed 70,000 dollars from Person B, I will be the sole answer of the house and responsible for the maintenance and utlities of the Property.Person B will not have any share in the ownership of the property.

I Plan to pay Person B monthly rent given his share in purchaing the house, estimated rent of the property is $2600. I will be paying rent $489 monthly based on the percent of the money I borrowed.

Monthly rent can be variable subject to the amount of loan paid back by Person A to Person B in installments. Time limit for contract is one year

Kindly ley me know if the amount of rent person B is receiving will not be interest? If there is any other suggestion or modification please let us know.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

If A borrowed $70 000 from B to purchase a house, A is the sole owner of the house.

B is only entitled to the amount he borrowed to A. B is not entitled to any monthly payment as rental for his loan of $70 000, any excess paid to B in the context of rental will  be interest (Riba).[i]

If B wants to make a profit, then he may purchase a share of the house equivalent to $70 000, B will then become a shareholder of the house with A. B may then rent out his share to A for a mutually agreed rental or may sell it to A according to a mutually agreed price. It is important to take note that the selling price must be fixed at the time of the sale.[ii]

باب الربا

ألحقه بالمرابحة لما أن في كل منها زيادة إلا أن تلك جائزة وهذه منهية والإباحة أصل فقدمت، وهو بكسر الراء وفتحها خطأ مقصور على الأشهر لغة مطلق والزيادة ومنه: {فلا يربوا عند الله} [الروم: 39] أطلق في التنزيل تارة على الزائد نفسه ومنه قوله تعالى: {لا تأكلوا الربا} [آل عمران: 130] أي الزائد في القرض وفي بيع الأموال الربوبية عند بيع بعضها بجنسه وأخرى على نفس الزيادة بالمعنى المصدري ومنه: {وأحل الله البيع وحرم الربا} [البقرة: 275] أي حرم أن يزاد في القرض على القدر المدفوع، وفي بيع الأموال بجنسها قدراً ليس مثله في الآخر وعرفاً (هو فضل مال) ولو حكماً فدخل ربا النسيئة والبيوع الفاسدة كالبيع بشرط فإنهم جعلوها من الربا وهذا أولى من قول بعضهم المقصر تعريف الربا المتبادر عند الإطلاق وذلك إنما هو رد الفضل (بلا عوض)
