Marriage without the permission of the wali
Question
Aslmkm respected scholars hope the entire team is doing well.
I would like to ask a question pertaining to marrige .
1) what is milka marrige ?
2) can a hanafi women marry without any approval from her elders?eg:parents.
Answer
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
1) We don’t know what is milka marriage, you may research that and revert to us for a ruling[i].
2) It is inappropriate for an adult female to marry without the blessing & consent of her guardian(wali)[ii]. However, if she marries without the consent of her guardian, the marriage will be valid if the marriage is to her Kuf’ (compatibile in Shariah). If she marries a person who is not her Kuf’, the marriage will not be valid.[iii]
