Partnership on land

Question

Five of my brother-in-law's colleagues were looking for someone who can be a partner of installment for a piece of land that they were going to buy from a real-estate company. My brother-in-law told me about this and I started to give installment with them. Now, six of us were giving installment for the land. I don't know my brother-in-law's colleagues, I just give monthly installment to my brother-in-law and he then gives that to those other five parthers and they give it to that company. I didn't notice what exactly was written in the contract, I only knew that six of us will get the ownership of that land once we finish installment over a period of three years. Recently I have started practicing Islam and now I want to make sure everything I do with money is halal. So I looked into the contract and found that it states that we need to pay some interest if we delay our monthly installment. I asked some scholars and they said it is haram. So I wanted to get rid of this land contract. I already have gave installment for about two years and we never delayed any installment. Now, since I want to withdraw from the partnership of shared installment, I told my brother-in-law and he told me that I need to find someone who can replace me. My brother-in-law found someone who wants to continue my share of installment and he will get the land once installment is complete. That person will now give me back the money that I gave in installment so far.

Now I'm afraid that I am getting rid of this haram thing yet another person is taking it over. If he gives me back my money, will this money be halal for me? Everything has happened through my brother-in-law and I don't know any of those people in person. I cannot just withdraw my partnership because it will be burden on other five partners to carry on with my share of installment, so I had no choice but to find someone who can replace me. Please advise, is my money that I'm going to get back halal?

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

We commend you on your Allah consciousness with regards to earning Halal.

In principle, the condition to pay interest if the payment is delayed is not permissible. However, given that you have already entered into this contract, it would be easier to abide by the contract provided each partner makes a firm resolution to pay timeously and avoid paying interest. This is similar to using a credit card with a bank. In essence, there is a stipulation of interest in the contract which is incorrect. However, as long as one does not delay payments, actual interest will not be incurred. [1]

If you still opt to withdraw from the contract and sell your rights to another individual, it will be permissible to do so and the income received will be Halal.

۲۱۱ - حكم غرامة التأخير والدخول في العقد بهذا الشرط : المسألة الثالثة : حكم التعاقد مع مصدر البطاقة في حين أن العقد يُصرّح بأن حامل البطاقة إن لم يُسدّد الفاتورة خلال فترة السّماح ، التي هي شهر عادةً ، فإنّ المصدر يتقاضى عليه زيادةً ، فإنّ مثل هذا الاشتراط محرم شرعاً لكونه رباً ، ولكن يُمكن لحامل البطاقة التحرز منه ؛ بأن يأمر مصدر البطاقة أن يحسم مبلغ الفاتورة من حسابه مباشرة ، وقد تسمع بعض شركات البطاقة بذلك إما من حساب حامل البطاقة عند المصدر ، وإما من حسابه في بنك آخر . أما إذا لم يتيسر ذلك ، فهل يجوز لمسلم أن يأخذ البطاقة ويوقع على العقد الذي فيه هذا الشرط بنيّة أنه سيدفع الفواتير في حينها قبل أن تفرض عليها زيادة ربويّة ، ولا يُطبق هذا الشرط فعلاً ؟ فيه خلاف للعلماء المعاصرين ؛ فقال بعضهم : إن مجرد التوقيع على هذا الشرط دخول في عقد محرّم ، فلا يجوز ، ولو كان بنيّة عدم تطبيقه في الواقع . وقال آخرون : إن حامل البطاقة إن كان على يقين بأن هذا الشرط لا يُطبق فعلاً لعزم أدائه مبلغ الفاتورة خلال الفترة المحددة ، فإنه يجوز . واستأنسوا لذلك بحديث عائشة في قصة بريرة ، حيث قال لها رسول الله : « اشترطي لهم الولاء ، فإن الولاء لمن أعتق  . فأجاز هذا الاشتراط ، لأن الشرط لا يُطبق فعلاً . ولكن هذا الاستدلال فيه نظر ، لأن رسول الله كان في قدرته أن يبطل هذا الشرط ، وقد أبطل ذلك في خطبته التي خطبها بعد ذلك . أما حامل البطاقة ، فليس في مكنته أن يُبطل هذا الشرط ، غاية ما في وسعه أن يؤدي الفاتورة في حينه لئلا يُطبق الشرط ؛ ولكنّ مثل هذه الشروط قد عمت بها البلوى في زماننا ، فإن مثل هذه الشروط تُوجد في كثير من التعاملات ، مثل : التعامل مع شركة الكهرباء ، وشركات الهواتف و غيرها ، فإن شرط غرامة التأخير موجود في جميع ذلك ، ولكن يشكل القول بأنه لا يجوز للإنسان أن يتعاقد مع هذه الشركات للحصول على الكهرباء والهاتف وغير ذلك ، بل جرى التعامل على أن الإنسان يتعاقد معها من غير نكير ، بشرط أن يكون في عزمه أن يؤدي واجباته في حينها ، وإنّما أجيز ذلك لحاجة عامّة ، فإن لم يتيسر الحصول على بطاقة الحسم الفوري ، ولا التعاقد مع مصدر البطاقة بأن يسحب مبلغ الفاتورة من حساب الحامل ، واشتدّت الحاجة إلى مثل هذه البطاقة ، فالمرجو أن حاملها يُعتبر معذوراً في الدخول في هذا العقد إن شاء الله تعالى بعد أخذ جميع الاحتياطات اللازمة لأن لا يَلجأ إلى دفع الفائدة الربوية ، والله أعلم
