Gifts to Family Members & Eating from Majority Haraam Income

Question

1) Can you please clarify if it is permissable to receive gifts within family?

2) Also what is the ruling on eating food at somebody's house who's majority income MAY be from alcohol?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

It is permissible and in fact encouraging to give and receive gifts within one’s family as that enhances love and harmony in the family.[1]

In principle, if it is known that a Muslim person’s major source of income is from Haraam, it is not permissible to eat there. If one is not certain of that, it is not necessary to probe into the issue. Shari’ah advises us to have good opinions of fellow Muslims.

عَنْ أَبِي هُرَيْرَةَ وَحَكِيمِ بْنِ حِزَامٍ قَالَا: قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ -: " «خَيْرُ الصَّدَقَةِ مَا كَانَ عَنْ ظَهْرِ غِنًى، وَابْدَأْ بِمَنْ تَعُولُ» " رَوَاهُ الْبُخَارِيُّ وَرَوَاهُ مُسْلِمٌ عَنْ حَكِيمٍ وَحْدَهُ

1930- وَعَنْ أَبِي مَسْعُودٍ قَالَ: قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ -: " «إِذَا أَنْفَقَ الْمُسْلِمُ نَفَقَةً عَلَى أَهْلِهِ وَهُوَ يَحْتَسِبُهَا كَانَتْ لَهُ صَدَقَةً» ". مُتَّفَقٌ عَلَيْهِ

1931- وَعَنْ أَبِي هُرَيْرَةَ قَالَ: قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ -: " «دِينَارٌ أَنْفَقْتَهُ فِي سَبِيلِ اللَّهِ، وَدِينَارٌ تَصَدَّقْتَ بِهِ فِي رَقَبَةٍ، وَدِينَارٌ تَصَدَّقْتَ بِهِ عَلَى مِسْكِينٍ، وَدِينَارٌ أَنْفَقْتَهُ عَلَى أَهْلِكَ. أَعْظَمُهَا أَجْرًا الَّذِي أَنْفَقْتَهُ عَلَى أَهْلِكَ» ". رَوَاهُ مُسْلِمٌ

اگر آدھا مال حرام اور دوسرا آدھا حلال تو اجتناب ضروری ہے۔ جہاں مال حرام زیادہ ہو وہاں قبول کرنا درست نہیں۔

رجل اهدي الي انسان أو أضافه ان كان غالب ماله من حرام لا ينبغي ان يقبل ويأكل من طعامه ما لم يخبر ان ذلك المال حلال استقرضه أو ورثه، وان كان غالب ماله من حلال فلا بأس بان يقبل الهدية ويأكل ما لم يتبين له ان ذلك من الحرام
