Lying about Talāq

Question

please help one time one of my friend said "have you and your wife gone your separate ways? meaning have you guys got divorced ? and i said" yes "i don't have a wife anymore we have gone our separate ways meaning i left her" but i was lying but i never had any intention of divorcing my wife BROTHER, and the reason why i said this is because i didn't want want them to know my business but i quickly change my statement and said " yes i have a wife" but all i wanted was them not to know my business. is this divorce brother? jazakallah brother 

but note brother i have no intention of divorving my wife

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Your friend asked you"Have you and your wife gone your separate ways? In response to that, you said “yes ". While your friend could have meant divorce by separate ways, that was not your intention. Therefore, your response to his question does not constitute divorce.[1]

وَالْحَاصِلُ أَنَّ قَوْلَهُمْ الصَّرِيحُ لَا يَحْتَاجُ إلَى النِّيَّةِ إنَّمَا هُوَ فِي الْقَضَاءِ أَمَّا فِي الدِّيَانَةِ فَمُحْتَاجٌ إلَيْهَا لَكِنَّ وُقُوعَهُ فِي الْقَضَاءِ بِلَا نِيَّةٍ إنَّمَا هُوَ بِشَرْطِ أَنْ يَقْصِدَهَا بِالْخِطَابِ. . . إلَخْ هَذَا، وَفِي الْقُنْيَةِ عَنْ الْمُحِيطِ رَجُلٌ دَعَتْهُ جَمَاعَةٌ إلَى شُرْبِ الْخَمْرِ فَقَالَ إنِّي حَلَفْت بِالطَّلَاقِ أَنِّي لَا أَشْرَبُ وَكَانَ كَاذِبًا فِيهِ ثُمَّ شَرِبَ طَلُقَتْ، وَقَالَ صَاحِبُ التُّحْفَةِ لَا تَطْلُقُ دِيَانَةً اهـ 

أَيْ فَقَوْلُهُ: طَلُقَتْ أَيْ قَضَاءً وَهُوَ مُوَافِقٌ لِمَا مَرَّ مِنْ أَنَّهُ إذَا أَقَرَّ بِالطَّلَاقِ كَاذِبًا وَقَعَ قَضَاءً لَا دِيَانَةً

ولو أقر بالطلاق كاذبا أو هازلا وقع قضاء لا ديانة. الدر المختار وحاشية ابن عابدين (رد المحتار) (236/3)

قال: أنت طالق أو أنت حر وعنى الإخبار كذبا وقع قضاء، إلا إذا أشهد على ذلك. الدر المختار وحاشية ابن عابدين (رد المحتار)
