Fatwa #304728 May 2001South Africa

Can a group of people, club together in order to raise funds to send under- priveledged persons on Hajj.

Question

A group of 50 people have formed a club to raise funds to send poor persons on haj. The people are selling cakes, have tea parties, etc . The people who will be going on haj has not yet been identified, but could be from amongst themselves. Is it permissible to send people on Haj with fund raised in this manner.

Answer

It is permissible to raise funds to send underpriviledged people for Hajj.
However, of concern is the possibility of a dispute as to who will be sent
for Hajj with such funds.

In principle, if there is a possibility of anything inconsistent with Shari'
ah in performing a permissible act, that act will be prohibited.
