Wife gave up on marriage and husband issued three Talaqs.
Question
The husband and wife constantly argue and never seem to agree on things. He keeps to himself and she occupies herself with the children and household duties.
They recently got into an argument and he hit her. She told him that she gives up on the marriage and he thinks about what is to come next and gives her the three talaqs. The lady would now like to know if the talaqs are valid.
The husband is reluctant to consult a local Moulana or Mufti and tries to comfort her ( a revert to Islam) and assures her that the talaqs are not valid.
She would like to know the way forward.
Answer
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
In principle three talaqs whether issued at once or on different occasions constitutes talaq-e-mugallazah (a permanently irrevocable divorce).[1]
Consequently, the talaqs issued by the husband are valid. The nikah has been broken and they have now become haram for each other.
