Paying Zakaat on behalf of ones wife

Question

Me and my wife calculated the amount of Zakaat and discussed that we will pay it off every month till it completes. Now my wife has left me for her mom house and has not yet returned.
If I pay a fix amount every month till full Zakaat is paid off,, will Zakaat be valid or my wife must pay her own for Zakaat to be valid. Please advise.

Answer

In the name of Allāh, Most Gracious, Most Merciful

Assalāmu ῾alaykum wa Rahmatullāhi Wabarakātuh

The zakat which you pay on behalf of your wife, with her consent, will be valid and be rightfully discharged. There is no need for her to personally pay her own zakat if such an arrangement is in place.

[1] قال في البحر ولو تصدق عنه بأمره جاز ويرجع بما دفع عند أبي يوسف ,  وعند محمد لا يرجع إلا بشرط الرجوع اه تأمل

   ثم قال في التاترخانية أو وجدت دلالة الإذن بالخلط كما جرت العادة بالإذن من أرباب الحنطة بخلط ثمن الغلات .....

فيه إشارة إلى أنه لا يشترط الدفع من عين مال الزكاة ولذا لو أمر غيره بالدفع عنه جاز كما قدمناه (رد المحتار , كتاب الزكاة , مطلب فى زكاة ثمن المبيع وفاء)
