Can one give Zakaat to his son in law?

Question

 can a person give zakat to his son inlaw to pay his debts. son in law is working hard for his living ,but there ,s no much left to pay his debt back .so can fatherinlaw give his zakat to son inlaw  to pay his debt.thank you.

Answer

In the name of Allāh, Most Gracious, Most Merciful  


Assalāmu ῾alaykum wa Rahmatullāhi Wabarakātuh

It is permissible to give zakāh to one’s son in law,[1] on condition he is a legitimate recipient of zakāh.[2]  (i.e. At the time of receiving zakāh, apart from miqdāri qaradh (the amount of debts) he is not a sāhib nisāb.)

1 وَقُيِّدَ بِالْوِلَادِ لِجَوَازِهِ لِبَقِيَّةِ الْأَقَارِبِ كَالْإِخْوَةِ وَالْأَعْمَامِ وَالْأَخْوَالِ الْفُقَرَاءِ بَلْ هُمْ أَوْلَى ؛ لِأَنَّهُ صِلَةٌ وَصَدَقَةٌ .  وَفِي الظَّهِيرِيَّةِ : وَيَبْدَأُ فِي الصَّدَقَاتِ بِالْأَقَارِبِ ، ثُمَّ الْمَوَالِي ثُمَّ الْجِيرَانِ ، وَلَوْ دَفَعَ زَكَاتَهُ إلَى مَنْ نَفَقَتُهُ وَاجِبَةٌ عَلَيْهِ مِنْ الْأَقَارِبِ جَازَ إذَا لَمْ يَحْسِبْهَا مِنْ النَّفَقَةِ بَحْرٌ وَقَدَّمْنَاهُ مُوَضَّحًا أَوَّلَ الزَّكَاةِ . وَيَجُوزُ دَفْعُهَا لِزَوْجَةِ أَبِيهِ وَابْنِهِ وَزَوْجِ ابْنَتِهِ تَتَارْخَانِيَّةٌ . 2والغارم من لزمه دين ولا يملك نصابا فاضلاً عن دينه. ((هوالخامس من المصارف))  (هدايه،كتاب الزكوة)
